M Cubed Business Insights LLC Privacy Policy
Effective Date: October 16, 2026
1. Introduction and Scope
This Privacy Policy ("Privacy Policy") describes how M Cubed Business Insights LLC ("M Cubed," "we," "us," or "our") collects, uses, and discloses Personal Data. It applies to our websites, to our applications and the products available through them, and to our support channels and communications (together, the "Services").
Defined Terms:
- "Personal Data" means any information relating to an identified or identifiable individual that we store or process as described in this Privacy Policy.
- "Customer" means a business entity that has entered into an agreement with us to use the Services.
- "Customer Data" means the data a Customer or its users upload to, connect to, pass through, or store in the Services.
- "Controller" means the entity that decides why (purposes) and how (means) Personal Data is processed. We are the Controller of the Personal Data we collect from the visitors to our websites, from holders of user accounts for our Services, and from people who contact us. Each Customer is the Controller of its own Customer Data.
- "Processor" (called a "service provider" under some state laws) means a party that processes Personal Data on a Controller's behalf and only processes said data in accordance with the Controller's instructions. We are the Processor of Customer Data in conjunction with our Services.
- "Service Providers" means companies that process Personal Data on our behalf to perform services for us, which include hosting, database software, email delivery, authentication, support, security, AI model providers, and other tools or services that are used by us to perform our services. Service Providers may use Personal Data only to provide those services to us.
- "Cookies" means bits of data which are sent to your browser or device and stored there. These bits of data are sent back to the server that sent them each time your browser connects to it. We use two types of Cookies: session Cookies are deleted when you close your browser; persistent Cookies remain until deleted.
Capitalized terms not defined here have the meaning given to them in our Terms of Service.
Unless stated otherwise, this Privacy Policy only covers the Personal Data for which we act as a Controller as defined herein. When a Customer uses the Services to collect or process Personal Data for its own business, including Customer Data, we act as that Customer's Processor. In such a case, the Customer's own privacy practices apply. This Privacy Policy does not govern Customer Data. If you have questions about how a Customer handles your Personal Data, or want to exercise rights in connection with Customer Data, please contact the Customer.
Information about our employees, contractors, and job applicants is not governed by this Privacy Policy. If you do not agree with the practices described here, do not use the Services.
2. What We Collect
What we collect depends on how you interact with us. The majority of interactions fall into one of three groups.
Information you or your Customer give us.
Account Information. When a user account is created, the Customer may provide us with the contact information and account credentials for each user account holder associated with the Customer's account.
Communications. If you contact us via email, open a support request, or otherwise reach out to us in any form, we may keep your contact details and the contents of the message/conversation.
AI Feature Inputs. When you use an AI feature in the Services, we collect what you input into the AI feature and any account information used by the AI feature in conjunction with the interaction. Please refer to Section 6 for more detail on how we use your data obtained through AI features.
Information collected automatically.
Logs. Our servers may record information your browser sends when you use the Services, including the web address that you originated from, information about your device, information about your operating system, browser type, IP address, approximate location derived from that IP address, and the date/time of your request.
Cookies. The Cookies we use may include the ones required to sign you in, keep your session active, and remember your settings. Please refer to Section 5 for more detail on Cookies.
Usage Data. We collect telemetry and data about how the Services are used so that we can monitor, analyze, and improve our Services. Usage Data usually does not include Customer Data; to the extent it does, that data is treated as Customer Data.
Customer Data.
Customers may use the Services to connect, upload, and analyze their own business information and to communicate with their own customers and contacts. They may also upload their customers' data. Whatever they upload into the Services is Customer Data. We store and process it as a Processor, on the Customer's instructions and under our agreement with each Customer. The Customer decides what is uploaded, remains responsible for it, and is responsible for any notice or consent the law requires before Personal Data is provided to us.
We do not intentionally collect government identification numbers, payment card numbers, or health information as a product feature, and we ask that you not submit them unless a separate written agreement with us governs this type of data.
3. How We Use Personal Data
This section applies to Personal Data that we control. Customer Data is processed only on the Customer's instructions and as our agreement with the Customer governs.
We use the Personal Data that we control to provide and maintain the Services for our Customers. This includes the following:
- creating and managing user accounts;
- verifying your identity and your permission(s) to use the Services;
- responding to inquiries;
- handling service errors, security, and technical issues;
- preventing fraud and abuse and investigating potential violations of our agreements with Customers or other policies;
- operating the AI features a Customer has access to, as per Section 6; and
- performing research and analysis about how the Services are used so that we can improve them and develop new features.
We also use the Personal Data that we control to communicate with you. That means service and administrative messages: notices about your account, changes to the Services, our agreements with Customers, or this Privacy Policy, and security or fraud alerts. Those messages are part of the Services, and you cannot opt out of them. We do not send promotional or marketing email.
Finally, we use Personal Data that we control where needed in order to protect our own rights and interests and those of our Customers and others, to enforce this Privacy Policy and our agreements with Customers, and to meet our legal and regulatory obligations, including requests from law enforcement or other authorities and legal proceedings involving M Cubed.
4. Who We Share Personal Data With
We share Personal Data in the following circumstances and not otherwise.
Service Providers. We share Personal Data that we control with companies that work for us (that provide hosting and content delivery, database hosting, AI model providers, email delivery, authentication, support tools, security monitoring, and other services). These companies may have access to Personal Data in order to do their jobs. We require them to protect it with reasonable security measures, and we do not authorize them to use or disclose it except to provide their services to us or as required by law.
Your Customer. If your account was set up for you as part of a Customer's organization within our Services, we may share your account information and all data associated with your account with that Customer.
Professional Advisors. Our attorneys, accountants, insurers, and similar advisors, who are bound by duties of confidentiality, receive Personal Data in order to provide their services to us.
Legal Process and Protection. We may disclose Personal Data where we believe disclosure is necessary to comply with a law, regulation, or governmental request; to respond to a subpoena, court order, warrant, or other legal process/demand; to enforce our agreements with Customers or this Privacy Policy, including investigating potential violations; to protect the safety, rights, or property of the public, any person or entity, or ourselves; to detect, prevent, or address security or technical issues or suspected illegal activity, including fraud; or as evidence in litigation in which we are involved as a party or otherwise.
Reorganization Event. Personal Data may be transferred to the parties involved, subject to this Privacy Policy, if we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of our assets.
Customer Data is associated with the Customer that provided or connected it; Customers do not receive other Customers' data through the Services. We do not sell Personal Data, and we do not share it for cross-context behavioral advertising, as those terms are defined under applicable state privacy laws.
5. Cookies and Tracking
We only use the Cookies that are necessary to sign you in, keep your session active, and remember your settings. We use both session Cookies and persistent Cookies. We do not use advertising Cookies. We do not track your activity across third-party websites. Our servers also keep the log records described in Section 2.
Most browsers let you block or delete Cookies through their settings. Since we require some Cookies to sign you into our Services, blocking them may keep you from signing in.
6. AI Features
Some of the Services, including the Ask Mike assistant, use artificial intelligence. When you use one of these features, the information and data that you enter, together with the information from your account that the feature uses to assist in answering (which may include Customer Data), is sent to a third-party AI model provider so that the feature can generate a response. Account information the feature does not use to assist in answering is not sent to a model provider through that feature.
Our AI model providers are not permitted to use the information we send them to train their models. We do not use your Personal Data or Customer Data to train artificial intelligence models.
AI output can contain errors or it can be incomplete. It is there to assist you, not to replace your own judgment and research, so review all outputs before you rely on it. The output is not itself a decision. Any decision about credit, collections, or anything else that affects a person shall be made by you or your organization. Do not enter sensitive or confidential information into AI features.
Our own team also uses AI tools from vendors for software development and other internal work. These tools have access to our source code and not to Customer Data or the contents of our production database.
7. Sensitive Information
The only information we purposely collect for our own purposes that some laws treat as sensitive is your account log-in credentials. We do not request health information, government identification numbers, payment card numbers, precise location, or biometric information. We ask that you not send any of the aforementioned information to us. If sensitive information reaches us anyway and we become aware of it, we may delete it or ask you to remove it. Until it is removed or deleted, it will be handled like the other information you provide. We do not sell sensitive information.
8. Your Choices and Rights
If you hold a user account, you can keep your Personal Data accurate and updated by asking us to update it. To close an account, email us at info@mcubedbi.net; we will close it and delete or de-identify your Personal Data as described in Section 9, apart from anything we are required or permitted to keep. If your user account is tied to a Customer of ours, you should reach out to that Customer to delete your account, as we may reject your request in this scenario. You may block or reject Cookies in your browser settings, however, please note the sign-in consequence in Section 5.
Depending on where you live, you may also have additional rights with respect to your data. For example, you may have additional rights to access, correct, or delete your data. To exercise additional rights granted to you under local laws, email us at info@mcubedbi.net and we will respond as applicable law requires. Before we act on a request we may verify that it comes from you. This may include confirming it from the email address on your account or through the Customer that arranged your account. We will not fulfill a request we cannot reasonably verify. We will not treat you differently for exercising your rights.
If your Personal Data sits in Customer Data, we will refer your request to the Customer and assist the Customer as our agreement with that Customer requires. Please note, our websites may link to third-party sites and applications, whose privacy policies govern your use of those sites and applications. This Privacy Policy only applies to our Services and not to third-party sites or applications.
9. Keeping Your Information
We may keep Personal Data for as long as we need it for the purposes it was collected and to meet our contractual and legal obligations. We may keep the records needed to bring or defend a claim for the applicable limitations period. How long we keep Personal Data depends on the amount, nature, and sensitivity of the data, the risk of harm from unauthorized use or disclosure, the purposes we process it for, and what the law requires. When Personal Data is no longer needed, we delete it or de-identify it. Customer Data is retained and deleted as our agreement with the Customer governs.
10. Security
We maintain systems, applications, and procedures designed to secure Personal Data and to reduce the risk of theft, damage, loss, or unauthorized access/use. We also use third party applications and services for the same. We take many measures to protect your data, including user accounts that have password requirements, requiring two-factor authentication for administrative access to our database, data that is encrypted in transit and at rest, and monitoring that alerts us to suspected attacks on our database and lets us suspend access. However, no system is perfectly secure, and we cannot guarantee that Personal Data will never be accessed, altered, or destroyed without authorization.
You play a role in this as well. Make sure you always choose a unique and complex password for each of your accounts, keep your log-in credentials private, and if you believe your account has been compromised, contact us at info@mcubedbi.net.
11. Children
The Services are intended solely for adults and for business use. Persons under 18 are not permitted to use our Services, and we do not knowingly or purposely collect Personal Data from anyone under 18. If we learn that we have collected Personal Data from a person under 18, we will close the account and delete the information as the law requires.
12. Where We Process Information
M Cubed is located in the United States of America. The information we collect is processed and stored in the United States of America, under privacy laws that may differ from those of other countries. If you use the Services from outside of the United States of America, your Personal Data will be transferred to the United States of America. If you are located outside the United States of America, including in the European Economic Area, the United Kingdom, or Canada, you may have additional rights under local law, and you can contact us at info@mcubedbi.net to exercise them.
13. Changes to This Privacy Policy
This Privacy Policy is current as of the Effective Date above. We reserve the right to change this Privacy Policy at any time, with or without notifying anyone. When we make a change, we post the updated Privacy Policy at this location with a new Effective Date, so check back from time to time.
14. Contacting Us
